Terms of Service

LAST UPDATED — OCTOBER 2026
This is a starting template, not legal advice. Have a lawyer review it before you take real payments — the specifics change depending on your state and how you structure the business.

1. Agreement

By creating an account you agree to these terms and to the Acceptable Use Policy. If you're using the service for a company, you confirm you're authorized to bind that company.

2. Accounts

You're responsible for everything that happens under your credentials, including anything your sub-accounts do. Keep your API key private. Tell us right away if you think it leaked.

You must be 18 or older to hold an account.

3. Bandwidth and payment

3a. ISP subscriptions and automatic renewal

4. Refunds

All sales are final. Bandwidth is delivered to your account the moment payment clears, so a purchase is not refundable because you changed your mind, bought the wrong amount or tier, or no longer need it.

The one exception is a product that does not work. If the proxies you were sold are not functioning as described, open a support ticket in our Discord first with your order ID and a description of the problem. We will investigate and, where the fault is ours and the bandwidth is substantially unused, issue a refund or replacement bandwidth at our discretion. We need the chance to fix it before anything is refunded — most problems are configuration and are resolved in minutes.

ISP subscriptions: a renewal can be refunded if you contact support within 48 hours of the charge and the set has not been used since; otherwise cancel to stop the next charge. Refunding a charge ends the set and releases its IPs.

Bandwidth you have already consumed is never refundable, and an account suspended for breaching the Acceptable Use Policy is not refunded.

Chargebacks. Filing a chargeback or payment dispute without opening a support ticket first is a breach of these terms. It results in immediate and permanent suspension, forfeiture of any remaining bandwidth and referral rewards, and we will contest the dispute with records of your usage.

5. Acceptable use

The Acceptable Use Policy is part of these terms. Breaking it can get your account suspended or terminated without a refund, at our discretion and without notice where the conduct is serious.

6. Availability

We aim for high availability but don't guarantee uninterrupted service. Bandwidth consumed against a pool we've confirmed as degraded gets credited back once the incident closes.

7. Limitation of liability

The service is provided as is. To the maximum extent the law allows, our total liability for any claim is capped at the amount you paid us in the 30 days before the claim arose. We're not liable for lost profits, lost data, or consequential damages.

8. Indemnity

You agree to cover our costs if a third party brings a claim against us because of how you used the service.

9. Termination

You can close your account at any time. We can suspend or close an account that breaks these terms, presents a legal risk, or triggers our abuse systems. Bandwidth on a terminated account is forfeited unless the termination was our error.

10. Changes

We may update these terms. Material changes get posted in Discord and emailed to account holders at least 7 days before they take effect.

11. Privacy

How we handle your information is described in our Privacy Policy.

12. Contact

Questions go to support@etherealproxies.com or a ticket in Discord.
